Sometimes, the best way to restore your gun rights is through the expungement process. Expungement is a process that can restore your gun rights by removing convictions from your criminal record.
You may qualify for expungement if you were convicted of a non-violent felony or misdemeanor. Violent crimes are not eligible for expungement.
For complex reasons, we do not recommend expungement if you qualify for a restoration of gun rights after a felony conviction until after your rights have been restored.
Finally, it is important to note that expungement in North Carolina is a state level process and will not expunge your federal criminal history. Also, expungement does not restore your gun rights federally, however, as a practical matter, you will be allowed to purchase, possess, and own guns after a felony conviction, because expungement removes the underlying charge from being considered a “conviction” under federal law.
