A common mistake is made in the Spanish speaking community of the U.S. when using the word notary. There is a distinct difference in the meaning of the word notary in English versus the meaning of the word notario in Spanish. There are many cases of notaries identifying themselves as notarios to take advantage of Spanish speaking immigrants and U.S. citizens who are not aware of the distinction.

Notario Publico descends from the Roman system and denotes a person with the title attorney. A notario can serve as an arbitrator, a mediator, and issue judicial opinions.

Conversely, the word notary descends from the English and signifies a public servant appointed by the state government to witness the signing of important documents and administer oaths. Notaries may not give legal advice.
