The Brady Handgun Violence Protection Act (The Brady Act) introduced mandatory background checks when a FFL sells a firearm to an individual. The Brady Act is codified under 18 U.S.C. § 922(t). These mandatory background checks are performed through the National Instant Criminal Background Check system, also known as NICS. The NICS system was designed to prevent disqualified individuals from obtaining a firearm.
